Terms of Service

These Terms of Service (“Terms”) govern your access to and use of vellostore.store (the “Site”) and any purchase you make from it. The Site is operated by Vello (“we”, “us”, “our”), a sole proprietorship registered in Quebec, Canada. By using the Site or placing an order you agree to these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least the age of majority in your province, state or country to place an order, or have the consent of a parent or legal guardian. By ordering you confirm that you meet this requirement and that the information you give us is accurate and complete.
2. Products, descriptions and availability
We make reasonable efforts to describe and picture our products accurately. Colours may vary between screens, and dimensions and weights are approximate. Product listings are an invitation to purchase, not a binding offer. We may limit quantities, restrict sales by geography, or discontinue any product at any time without notice.
Where a product is displayed with a crossed-out comparison price, that price is a manufacturer’s suggested retail price or a price at which the item was genuinely offered for sale, not an artificially inflated figure.
3. Orders, pricing and payment
All prices are shown in the currency selected at checkout and exclude import duties and destination taxes unless stated. Your order is an offer to buy; a contract is formed only when we send you a dispatch confirmation.
We reserve the right to refuse or cancel any order, including where a product was listed at an obviously incorrect price, where we suspect fraud, or where we cannot lawfully ship to your destination. If we cancel a paid order we will refund you in full.
You confirm that you are authorised to use the payment method you provide. Payments are processed by our payment providers; we do not store full card numbers.
4. Shipping, returns and refunds
Our Shipping & Delivery policy and Returns & Refunds policy form part of these Terms and are incorporated by reference.
5. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in breach of any applicable law or regulation;
- Attempt to gain unauthorised access to the Site, its servers or related systems;
- Introduce viruses, malware or any other harmful code;
- Scrape, harvest or systematically extract data from the Site without our written consent;
- Place fraudulent orders, abuse promotional codes, or use the Site to infringe the rights of others;
- Submit content that is defamatory, obscene, hateful, harassing or otherwise objectionable.
We may suspend or terminate your access for any breach of this section.
6. Intellectual property
All content on the Site, including text, graphics, logos, layout, photographs and the Vello name and branding, is owned by us or our licensors and is protected by copyright and trade mark law. You may not reproduce, distribute or create derivative works from it without our prior written permission.
If you believe content on the Site infringes your copyright or trade mark, please see our DMCA Policy or Trademark Infringement Policy.
7. User-submitted content
If you submit a review, comment, photograph or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it in connection with our business. You confirm that you own the content or have the right to grant this licence. We may remove any submitted content at our discretion.
8. Third-party links and services
The Site may link to third-party websites and use third-party services. We do not control those sites and are not responsible for their content, policies or practices. Your dealings with them are solely between you and them.
9. Disclaimer of warranties
Except for warranties that cannot be excluded by law, the Site and the products are provided on an “as is” and “as available” basis. We do not warrant that the Site will be uninterrupted, error-free or secure, or that any product will meet your particular requirements. Products are supplied with the manufacturer’s warranty, if any.
10. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or in connection with any order is limited to the amount you paid for the products giving rise to the claim. We are not liable for indirect, incidental, special or consequential loss, including loss of profit or data.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be excluded — including your non-waivable rights under the Quebec Consumer Protection Act, the UK Consumer Rights Act 2015 and equivalent consumer legislation in your jurisdiction.
11. Indemnity
You agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.
12. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
13. Governing law and dispute resolution
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable in it. The courts of the district of Montreal, Quebec have jurisdiction over any dispute.
If you are a consumer, this clause does not deprive you of the protection of the mandatory consumer law of your country of residence, or of your right to bring proceedings in the courts of that country where local law gives you that right.
Before commencing proceedings, we ask that you contact us so we can try to resolve the matter informally.
14. Changes to these Terms
We may update these Terms from time to time. The version in force at the time you place an order is the version that applies to that order. Material changes will be posted on this page with an updated date.
15. General
If any provision of these Terms is found unenforceable, the remaining provisions continue in force. Our failure to enforce a right is not a waiver of it. These Terms, together with the policies referenced in them, are the entire agreement between us.
